Purpose and legal basis for processing

We process personal information for three purposes:

  • To process your application for training from EMAQ
  • To inform you of forthcoming training courses and events from EMAQ
  • To hold a record of training you have completed from EMAQ

The legal basis we rely on for the first two purposes is your consent as in article 6(1)(a) of the GDPR.

For the third purpose, the legal basis we rely on is the need for public authorities to have access to records for those trained by EMAQ as in article 6(1)(e) of GDPR, sometimes referred to as public task. In the relatively few occasions where the training records for not for public authorities, the legal basis is legitimate interests of the employer as in Article 6(1)(f) of GDPR. In the latter cases, the legitimate interest of the employer is to have access to records of training by EMAQ of its employees.

What we need and why we need it

At present we process information on our users in the following ways:

  • voluntary submissions of information and details to register your interest whether through contacting a helpline, staff or administrators or registering through items such as a completed application form
  • storing information about completed training courses. This is so we can address queries from individuals or employers about staff training by EMAQ
  • by examination of the Log Files that all visitors involuntarily leave when they visit any web site - this provides a limited amount of information and we use this limited information we collect to measure the number of visitors to the website and help us to make the visit more useful to visitors;
  • automatic collection of data through the use of Cookies* and/or technologies to collect information to the website to enhance your overall site experience and for statistical purposes. You can set your browser to turn off cookies or to warn you when a website attempts to place a cookie on your computer. However, if you turn off the cookies, some website may not work properly.

What we do with it

  • Voluntary submissions of data through online registration of interest, contacting a helpline staff or administrators or applying for a course are stored and used as follows:
    • Where no consent is given for continuing contact, the specific contact is retained in logs, for instance of enquiries
    • Where consent has been given for ongoing contact, individuals will be sent messages relating to EMAQ activities
  • Records of completed training courses are stored for record-keeping and statistical purposes and to be able to report training information to employers as/if requested
  • Website logfiles and cookie information are used to assess usage of the website and to guide improvements

This information is NOT shared with other organisations for marketing purposes.

How long do we keep it

For data that we are processing based on your consent, you may remove your consent at any time.

We will seek renewal of consents periodically.

If you do not remove consent, we will retain your data until advised that you are no longer at the local authority in your contact details and wish to be removed.

We then deactivate your email address, postal address and phone number from our contact records.

Until advised otherwise by your employer, we will retain your training records.

What are your rights

You have a right to be informed about this processing of your personal data as in this notice. You also have the right to request from the controller access to and rectification of your personal data or to restrict processing of your personal data.

Where the lawful basis for processing your personal data is consent, you also have rights to data portability and to erasure of your data. You do not have a right to object to processing of your data, but you can withdraw consent at any stage. All messages sent from EMAQ include a link to unsubscribe. This withdrawal does not affect any processing prior to the withdrawal.

Where the lawful basis is public task, you do not have rights to erasure or data portability, but you do have a right to object to the processing.

For the few cases where the lawful basis for processing the data is the legitimate interests of your employer, you do not have a right to data portability, but you do have rights to request erasure of your data and to object to processing.

We use no third-party processors of the data.

We do use third-parties as trainers. Data is not passed to then, but they will see names and affiliations during training.

Do we make any overseas data transfers?

We make no transfers of data outside the UK.
