Land contamination is a material consideration under planning and development on brownfield sites is an important thread in the recent update to the NPPF. Under Part 2A of the Environmental Protection Act 1990 local authorities also have a statutory duty to inspect their area for the purpose of identifying and dealing with contaminated land. Recent judgments, including the Corby case, have highlighted the importance of non-statutory liabilities of local authorities. The starting point of any approach to the risk-based management of land contamination is understanding the legal context (planning, Part 2A of the Environmental Protection Act, common law) and formulating a conceptual site model (CSM). The course will provide an insight into the range of legal contexts and the role of the conceptual model to inform decision making. During the practical session there will be an opportunity for delegates to develop a conceptual site model, including the identification of associated uncertainties. This course is the first in a series of courses covering the basic risk assessment framework for land contamination. It will provide a basic understanding of the legislation involved and how the conceptual site model is the central focus for the risk assessment process. How the CSM is updated and used to drive the process forward will be a constant theme throughout the remaining courses. By the end of the course delegates should: • better understand what the planning and Part 2A regimes do and say; • know the phased approach to land contamination assessment in the UK; • know the basic requirements of a desktop study and site walkover survey; • understand how this information is combined into a conceptual site model and preliminary risk assessment; • have generated their own conceptual site model from desk study information; and • be better able to review simple Phase 1 reports The seminar stands alone but can be also undertaken as the first module of the EMAQ Essentials of CLM course - a structured programme of training leading to the Certificate in Contaminated Land (CLM) which is accredited by the Chartered Institute of Environmental Health (CIEH).
